We sell curated electronics & gadgets, fashion & apparel, home accessories and lifestyle products, as well as other products made available on our website from time to time.
We operate using a combination of direct retail, third-party fulfillment and drop-shipping arrangements. This means that certain products may be stored, packaged, processed and shipped directly to customers by third-party manufacturers, suppliers, warehouses, fulfillment partners or logistics providers on our behalf.
Vasckonet Services remains your point of contact regarding orders placed through our website.
2. ELIGIBILITY
By using this Website or placing an order, you confirm that; you are at least 18 years old or otherwise legally capable of entering into a binding agreement, the information you provide is accurate, complete and current, you are authorized to use the selected payment method, and your use of the Website complies with applicable laws.
We reserve the right to decline, suspend or cancel orders that we reasonably believe involve fraud, unauthorized activity, abuse or violation of these Terms.
3. PRODUCTS AND PRODUCT INFORMATION
We aim to provide accurate descriptions, photographs, specifications, colours, dimensions and other product information.
However, because certain products are supplied through third-party suppliers; packaging may occasionally differ from images shown, minor colour variations may occur due to lighting, photography or screen settings, manufacturers may make minor product-design or packaging changes, dimensions may contain reasonable manufacturing tolerances, and product availability may change without notice.
Such differences will not affect your statutory rights where a product is materially different from what was advertised, defective, unsafe or otherwise does not comply with applicable consumer-protection legislation.
4. PRODUCT AVAILABILITY
All products are subject to availability.
Adding a product to your shopping cart does not reserve that product.
If a product becomes unavailable after you place an order, we may: offer you an appropriate replacement or alternative, subject to your acceptance; place the relevant item on back-order where appropriate; or cancel and refund the affected item.
Where we cannot fulfill an order, we will handle any refund in accordance with applicable law.
5. PRICING
Prices are displayed on the Website in South African Rands but can be converted to the currency for your region.
Prices may change without notice.
The price applicable to your purchase will ordinarily be the price displayed at checkout when your order is submitted, subject to correction of obvious pricing or technical errors.
Shipping charges, applicable taxes, customs duties or other charges will be displayed where reasonably possible or communicated in accordance with applicable law.
6. PRICING AND WEBSITE ERRORS
Although we take reasonable steps to maintain accurate information, typographical, pricing, technical or inventory errors may occasionally occur.
Where an obvious error occurs, we reserve the right, subject to applicable law, to: correct the error; contact you for instructions; or cancel the affected transaction and issue any required refund.
We will not intentionally use pricing errors to mislead customers.
7. ORDERS
Submitting an order constitutes an offer to purchase the selected products.
After placing an order, you may receive an automatic order confirmation. This confirms receipt of your order but does not necessarily mean that fulfillment has begun.
We may verify; payment, billing information, shipping information, stock availability, suspected fraud or security concerns, and product fulfillment availability.
We reserve the right to refuse or cancel an order for legitimate reasons permitted by law.
8. ORDER CANCELLATIONS
If you wish to cancel an order, contact Vasckonet Services as soon as possible.
Where the order has not entered processing or shipment, we will make reasonable efforts to cancel it.
Once an item has been processed or dispatched, cancellation may no longer be operationally possible and the request may instead need to be handled as a return.
Nothing in this section limits any cancellation or cooling-off right available to you under applicable consumer law.
9. PAYMENT
Payment must be made using one of the payment methods offered at checkout.
Depending on availability, these may include credit or debit cards, electronic payment methods, digital payment services or other supported methods.
Your payment may be processed by an independent payment service provider and we do not guarantee uninterrupted availability of any particular payment method.
You agree to provide accurate billing information and warrant that you are legally authorized to use the payment method submitted.
10. FRAUD PREVENTION
For the protection of customers and our business, transactions may be subject to security and fraud-prevention checks.
We may request reasonable verification before processing certain transactions.
Orders may be delayed, rejected or cancelled where we reasonably suspect the following; fraudulent activity, stolen payment credentials, unauthorized transaction, identity misuse, abuse of promotions, or other unlawful conduct.
11. DROPSHIPPING AND THIRD-PARTY FULFILLMENT
Some Vasckonet Services products are fulfilled directly by third-party suppliers.
Accordingly: products in the same order may be shipped separately; products may originate from different countries; different items may have different delivery periods; tracking information may be issued separately; international fulfillment may involve customs processing; and third-party courier delays may occasionally occur.
Our use of suppliers or fulfillment partners does not remove statutory consumer rights you may have against Vasckonet Services.
12. SHIPPING AND DELIVERY
Shipping is governed by our separate Shipping Policy, which forms part of these Terms.
Any delivery dates or periods provided are estimates unless expressly represented as guaranteed.
Delivery may be affected by factors outside our reasonable control, including; customs processing, carrier delays, weather, strikes, public holidays, transport disruptions, incorrect delivery information, security inspections, natural disasters, supplier disruptions, and governmental restrictions.
Where applicable consumer legislation imposes specific delivery obligations, those legal requirements will prevail.
13. CUSTOMS, DUTIES AND IMPORT TAXES
International shipments may be subject to customs duties, VAT, import taxes, clearance fees or other government charges imposed by the destination country.
Unless expressly stated otherwise at checkout, such charges are not included in the product price and may be payable by the recipient.
Customs rules vary by jurisdiction.
Customers purchasing internationally are responsible for ensuring that the products ordered can legally be imported into their destination country.
This section does not permit Vasckonet Services to impose undisclosed charges contrary to applicable consumer law.
14. DELIVERY ADDRESS
Customers are responsible for providing a complete and accurate delivery address.
Please verify; recipient name, building or street number, street name, suburb, city, province/state, postal code, country, telephone number and any relevant delivery instructions.
Vasckonet Services will not be responsible for delays resulting solely from materially incorrect information supplied by the customer, to the extent permitted by law.
Additional shipping charges may apply where a parcel needs to be resent because an incorrect address was provided.
15. TRACKING
Where tracking is available, customers may receive a tracking number or order-tracking link after dispatch.
Tracking information can occasionally take several business days to update after a shipment enters the logistics network.
Tracking information supplied by couriers and logistics providers is provided for convenience and is subject to their systems.
16. RETURNS, REFUNDS AND EXCHANGES
Returns and refunds are governed by our Refund Policy, which forms part of these Terms.
Nothing contained in these Terms or our Refund Policy is intended to exclude or restrict rights which cannot legally be excluded under applicable consumer legislation.
17. ELECTRONIC TRANSACTION COOLING-OFF RIGHTS
Where the Electronic Communications and Transactions Act 25 of 2002 applies to your transaction, you may have the right to cancel an eligible transaction without reason and without penalty within the statutory cooling-off period.
Certain categories of transactions and goods may be excluded from this right under applicable legislation.
Where the statutory cooling-off right applies: the customer may be responsible for the direct cost of returning the goods; and refunds will be processed within the period required by applicable law.
Nothing in these Terms limits any statutory cooling-off rights applicable to your transaction.
18. DEFECTIVE, UNSAFE OR POOR-QUALITY GOODS
Customers in South Africa may have rights under the Consumer Protection Act 68 of 2008 concerning defective, unsafe or poor-quality goods.
Where the statutory implied warranty of quality applies, eligible customers may be entitled to return qualifying defective goods within six months of delivery and select a remedy permitted by law, including repair, replacement or refund where applicable.
These rights are separate from any voluntary store return policy.
19. DAMAGED OR INCORRECT ITEMS
If an item arrives damaged or you receive a materially incorrect product, contact Vasckonet Services promptly through our official Contact page or email.
Where reasonably possible, please provide; your order number, photographs or video showing the issue, photographs of the packaging, the shipping label and a description of the problem.
This information assists us in resolving your claim with suppliers and logistics providers.
Failure to provide photographs does not remove any statutory consumer right where other reasonable evidence is available.
20. PERSONAL AND HYGIENE PRODUCTS
For legitimate health, hygiene and safety reasons, certain products may have limited voluntary return eligibility once opened, worn or used.
This may include qualifying; personal-care items, health-related products, intimate apparel, cosmetics, grooming products and products where hygiene seals have been removed.
Any such limitation remains subject to mandatory consumer-protection rights concerning defective, unsafe or misrepresented products.
21. INTELLECTUAL PROPERTY
Unless otherwise stated, Website content including; logos, graphics, text, product layouts, branding, Website design, photographs created or owned by Vasckonet, videos and original written content, are owned by or licensed to Vascko Investments (Pty) Ltd. or its relevant licensor.
You may not reproduce, distribute, modify, commercially exploit or create derivative works from protected material without appropriate permission.
Third-party trademarks and product names remain the property of their respective owners.
22. ACCEPTABLE USE
You may not use the Website to; engage in fraudulent activities, introduce viruses, malware or malicious code, attempt unauthorized access to our systems, scrape or harvest Website data unlawfully, impersonate another person, interfere with Website operation, abuse promotions or payment mechanisms, violate intellectual-property rights, or engage in unlawful conduct.
We may suspend or restrict access where reasonably necessary to protect the Website, our customers or our business.
23. THIRD-PARTY SERVICES AND LINKS
The Website may contain links to third-party websites, applications, couriers, payment providers or other services. These third parties operate independently and may have their own terms and privacy practices.
We are not responsible for third-party websites that we do not own or control, subject always to any liability imposed on us by applicable law.
24. REVIEWS AND USER CONTENT
If you submit reviews, photographs, comments or other content to Vasckonet Services, you confirm that; you have the right to submit that content, it does not infringe another person's rights, it is not unlawful, fraudulent, defamatory or malicious; and it reflects your genuine experience where represented as a review.
We may moderate content for legitimate operational or legal reasons.
25. PROMOTIONS AND DISCOUNT CODES
Promotions, vouchers and discount codes may be subject to additional conditions.
Unless stated otherwise; promotions cannot be exchanged for cash, promotional codes cannot be reproduced or sold, only eligible orders qualify, some products may be excluded, and promotions may have expiry dates or stock limitations.
We reserve the right to reject fraudulent or unauthorized use of promotions.
26. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Vasckonet Services and Vascko Investments (Pty) Ltd. will not be liable for indirect, incidental, special or consequential losses arising solely from circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, nothing in these Terms removes any rights or remedies available under applicable South African consumer-protection legislation.
27. FORCE MAJEURE
We will not be responsible for failure or delay caused by events beyond our reasonable control, including; severe weather, natural disaster, war or civil unrest, epidemic or pandemic restrictions, customs disruption, widespread carrier disruption, strikes, governmental action, internet or infrastructure failures, or other comparable events.
Where such circumstances materially affect an order, we will take commercially reasonable steps to communicate with affected customers and comply with applicable consumer law.
28. PRIVACY
Our handling of personal information is governed by our Privacy Policy and applicable data-protection legislation.
By using our Website, you acknowledge that information required to process orders may be shared with appropriate service providers such as;
payment processors, fulfillment suppliers, couriers, logistics providers, Website-service providers, and fraud-prevention providers, to the extent reasonably necessary to provide our services and subject to applicable privacy law.
29. COMMUNICATIONS
By placing an order, you consent to receiving transactional communications necessary to administer your purchase, including; order confirmations, payment confirmations, shipping updates, delivery notifications, return communications, and customer-service messages.
Marketing communications are handled separately and may be subject to your consent and applicable law.
30. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa, without depriving consumers located elsewhere of any mandatory consumer protections that apply to them under applicable law.
Where legally permissible, disputes concerning these Terms will be subject to the jurisdiction of the competent courts of South Africa.
31. CONSUMER RIGHTS
Nothing in these Terms is intended to waive or exclude any non-waivable consumer right available under applicable legislation, including where relevant: the Consumer Protection Act 68 of 2008; the Electronic Communications and Transactions Act 25 of 2002; and other applicable South African legislation.
If a provision in these Terms conflicts with a mandatory provision of law, the mandatory legal provision will prevail.
32. CHANGES TO THESE TERMS
We may update these Terms periodically to reflect; operational changes, changes to our products, changes to Website functionality, legal requirements, or changes to our business practices.
The current version will be published on this Website with an updated effective date.
Changes will not retrospectively remove rights that have already accrued under applicable law.
33. SEVERABILITY
If any provision of these Terms is held to be unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
